1. Agreement and eligibility

These Terms are an agreement between you and Wyth, the brand operating thewyth.com. By using Wyth or purchasing a subscription, you agree to these Terms, the Privacy Policy, and the Refund and Cancellation Policy. You must be legally able to enter this agreement. Users under 13 may not use Wyth; additional local age or consent rules apply where required.

2. The service

Wyth provides AI-generated conversations, companion customization, language practice, translation, vocabulary, and related features. Features may change, be limited, or be discontinued as the product develops. AI output is probabilistic, may be incomplete or wrong, and must be independently evaluated before you rely on it.

3. Accounts and acceptable use

You are responsible for accurate registration information, safeguarding your credentials, and activity on your account. Do not use Wyth to violate law or others' rights; create or distribute abusive, exploitative, fraudulent, harmful, or infringing content; attempt unauthorized access; evade usage controls; scrape or resell the service; interfere with security; or use automated activity that imposes unreasonable load. We may restrict or suspend access reasonably necessary to protect users, Wyth, providers, or the public.

4. Plans, prices, and renewals

• Free trial: the first successful AI conversation may start a one-day trial without a card and without automatic renewal.
• Standard: USD $5 per month, including approximately USD $2 of monthly underlying model usage. When included usage is exhausted, access may be limited until renewal, upgrade, or an offered top-up.
• Unlimited: USD $10 per month for higher usage, subject to fair use, anti-abuse protections, capacity limits, and emergency cost controls. “Unlimited” does not permit automated, shared, resold, unlawful, or abusive use.

Paid subscriptions are billed in advance and automatically renew each month until canceled. Prices, taxes, and the renewal date are shown at checkout. We will provide legally required notice of material price changes.

5. Paddle is Merchant of Record

Our order process is conducted by Paddle.com Market Ltd or a Paddle affiliate. Paddle is the Merchant of Record and handles payment processing, applicable sales taxes, payment-related customer service, cancellations, and returns. Your purchase is also subject to Paddle's Buyer Terms and Privacy Notice.

6. Your content and intellectual property

You retain rights in content you submit and grant Wyth a limited license to process it only as needed to operate, secure, and improve enabled service functions. You represent that you have the right to submit it. Wyth, its design, software, and branding remain owned by Wyth and its licensors. These Terms do not transfer ownership.

7. Disclaimers and liability

To the maximum extent allowed by law, Wyth is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or non-infringement. Wyth is not liable for indirect, incidental, special, consequential, or punitive damages, or lost data, profits, or opportunities. Where liability cannot be excluded, aggregate liability will not exceed the amount you paid for Wyth in the 12 months before the claim. Mandatory consumer rights are not limited.

8. Ending use, changes, and contact

You may stop using Wyth at any time and cancel paid service under our refund policy. We may update these Terms; material changes will be posted with a new effective date. If you do not agree, stop using the service before the changes take effect. Questions: [email protected].
